A member writes: "When an hourly employee is paid for forty hours but works less than forty hours, under law that employee may be considered salary as far as overtime compensation. Is the reverse true? An hourly employee paid only for hours worked, forty if worked forty OR paid thirty eight for only thirty eight hours worked be classified as salary per the DOL? "
